NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Cullman County

American Proteins Inc., NPDES Permit Number AL0040843, located at 1170 County Road 508, Hanceville, AL 35077, address P.O. Box 429, Hanceville, AL 35077, for re-issuance of existing discharges resulting from treated process and sanitary wastewaters associated with rendering operations, discharging through DSN001 to Mulberry Fork; Cooling water pond overflow, discharging through DSN002 to Unnamed Tributary to Mulberry Fork; Storm water from rendering plant processing areas, discharging through DSN003 to Mulberry Fork; Storm water from rendering plant processing areas, discharging through DSN004 to Unnamed Tributary to Mulberry Fork; and Storm water from non-process areas, discharging through DSN005 to Unnamed Tributary to Mulberry Fork. All streams are classified as Fish and Wildlife streams and are in the Black Warrior River Basin.

In accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and the federal regulations (40 CFR Part 125), if applicable, the cooling water intake structure used by the Permittee has been evaluated using available information. At this time, the Department has determined that the cooling water intake structure used by the Permittee represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326).

Lee County

Southern Power Company H Allen Franklin Combined Cycle Power Plant , NPDES Permit Number AL0073555, located at 530 Lee County Road 330, Smiths, AL 36877, for reissuance of discharges resulting from cooling tower blowdown, low volume waste, and metal cleaning waste streams through DSN001 to the Chattahoochee River, classified as Fish & Wildlife, in the Chattahoochee River Basin.

In accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and the federal regulations (40 CFR Part 125), if applicable, the cooling water intake structure used by the Permittee has been evaluated using available information. At this time, the Department has determined that the cooling water intake structure used by the Permittee represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326).

Mobile County

Linde Gas, NPDES Permit Number AL0078913, located at 400 Industrial Parkway, Saraland, AL, 36571, for re-issuance of existing discharges resulting from process wastewater associated with hydrogen production, reject water, condensate, boiler blowdown, water filter backwash, DI water system regeneration and oil low volume utility wastewater, discharging through DSN001 and discharges resulting from noncontact cooling water, discharging through DSN002, both discharging to Chickasaw Creek, classified as Limited Warmwater Fisheries, in the Mobile River Basin.

The Department has determined that the entity providing water to the Permittee is a public water system in accordance with Section 1401 of the Safe Drinking Water Act; therefore, the Permittee is exempt from the requirements of Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and rules adopted under this section.

Russell County

WestRock Coated Board, LLC, PO Box 940, Phenix City, AL 36868, NPDES Permit Number AL0000817, located at Highway 65 South, Cottonton, AL 36851, for modification of discharges resulting from storm water associated with industrial activity including runoff from log storage areas, material storage areas, wooded areas, truck wash down area with oil/water separator, borrow area, and access roads and water used for wet decking operations, through DSN017 to an unnamed tributary to Mill Creek, classified as Fish and Wildlife and discharges resulting from non-contact cooling water, stormwater associated with industrial activity, and storm water from parking lots and recycle areas, through DSN002 to the Chattahoochee River, classified as Fish & Wildlife in the Chattahoochee River Basin.

Shelby County

Research Solutions Group, Inc., NPDES Permit Number AL0074276, located at 402 Industrial Park Drive, Pelham, AL 35124, for new discharges resulting from storm water from secondary containment area drainage and facility runoff, through DSN003, DSN004, and DSN005 to Cahaba Valley Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

Stella-Jones Corporation, NPDES Permit Number AL0054682, located at 1051 Highway 25 South, Montevallo, AL 35115, for reissuance of existing discharges resulting from boiler blowdown, non-contact cooling water, water softener regeneration effluent, and cooling tower blowdown through DSN002 and discharges resulting from stormwater associated with the lumber and wood products industry including wood treating operations using creosote or chlorophenolic formulations and inorganic preservatives containing copper, chromium, and arsenic through DSN003 and DSN007 to an unnamed tributary to Shoal Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

Washington County

Praxair, Inc., NPDES Permit Number AL0067687, located at 1636 Industrial Road, McIntosh, AL 36553, for re-issuance of existing discharges resulting from Air compressor condensate, hydrogen compressor condensate, hydrogen superheater condensate, cooling tower blow down, and contaminated stormwater discharge, discharging through DSN001 to Tombigbee River via ditch from Olin Chemical, classified as Fish and Wildlife, in the Tombigbee River Basin.

The cooling water intake structure the facility uses is owned and operated by BASF Corp and is subject to 316(b) requirements; however, those requirements are being met by the BASF Corp �McIntosh Plant (NPDES Permit AL0003093) and will continue to be evaluated during each subsequent reissuance of that permit.

The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Moody Swamp, classified as Fish & Wildlife, in the Black Warrior River Basin.

Duncanville Wetlands, LLC, Post Office Box 86, Duncanville, AL 35456, NPDES Permit Number AL0078841, for re-issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Duncanville Wetlands WWTF, 14985 Bear Creek Road, Duncanville, AL 35456, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Big Sandy Creek, classified as Fish & Wildlife, in the Black Warrior River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday - Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
