NOTICE OF PERMIT RENEWAL & MODIFICATION OF A CONSTRUCTION AND DEMOLITION LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

PICKENS COUNTY

The Pickens County Commission has submitted to the Alabama Department of Environmental Management an application to renew and to modify the Pickens County Inert Landfill (Permit No. 54-01). The Pickens County Inert Landfill is described as being located in Section 29, Township 20 South, Range 15 West in Pickens County, Alabama. The proposed modification would expand the total acreage of the facility to 66.13 acres (an increase of 16.31 acres). The modification also increases the acreage dedicated for waste disposal operations to 19.04 acres (an increase of 12.03 acres).On April 26, 2011 by Resolution, the Pickens County Commission granted approval to expand the existing landfill. Additionally, the modification also includes the replacement of a groundwater monitoring well. The waste stream for the Pickens County Inert Landfill would remain non-putrescible and non-hazardous construction and demolition waste and rubbish as defined by ADEM Rule 335-13-1-.03, and discarded tires. The service area for the Pickens County Inert Landfill would remain Pickens County, Alabama. The maximum average daily volume of waste disposed at the Pickens County Inert Landfill would remain 5 tons per day.

Copies of the public notice and proposed permit are available for public inspection electronically via the ADEM web site at adem.state.al.us/PublicNotice/PublicNotice.htm, and the complete application at the following location Monday - Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 35 days following the publication date of this notice. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
